Foam Packaging Restrictions Hardship Waiver

By July 1st, 2015, no food service establishment, mobile food commissary, or store will be able to use, sell, or offer expanded polystyrene single service food items or loose fill packaging (commonly known as packaging peanuts). More information about the Foam Packaging Restrictions can be found on the Department of Sanitation website.

Nonprofits and small businesses (not part of a chain) with less than $500,000 in revenue per year may apply for hardship exemptions from SBS if they can prove that the purchase of alternative products not composed of EPS would create undue financial hardship. SBS has begun accepting applications for hardship waivers.
